| Terms and Conditions of Sale and Delivery General Offers, deliveries and performances are carried out exclusively under these Terms and Conditions of Sale and Delivery unless other agreements were made expressly and in writing. The buyer’s conditions of purchase are only binding to the extent that they do not conflict with these Terms and Conditions or were expressly acknowledged and confirmed in writing. I. Delivery obligations 1. The written acknowledgement of an order shall be relevant for the scope of delivery. Additional agreements and amendments require the written confirmation of COSLINE. Part deliveries are permissible. 2. Disruptions and events of force majeure entitle COSLINE to extend the agreed delivery time and, if the specific circumstances require this, to rescind the delivery obligations as a whole or in part. 3. Information given in brochures and illustrations are not mandatorily relevant; changes to or perfection of COSLINE goods are permissible. II. Offer The documentation pertinent to the offer, such as illustrations and drawings, is only approximately relevant unless it was expressly designated as binding. COSLINE shall reserve the copyright to this documentation. III. Prices and payments 1. The prices listed in the price list of COSLINE are quoted in CHF and as gross prices including statutory VAT. By issuing the current price list all previous price lists and offers lose their validity. 2. Unless an agreement to the contrary was made, prices are from the place of business of COSLINE’s establishment plus postage and packing. 3. The delivery fee in Switzerland is CHF 2.90. IV. Advice on revocation Right of revocation You can revoke your contractual declaration within two weeks, without stating the reasons, in writing, that is e.g. by letter, fax or e-mail or by returning the goods. This period starts upon receipt of the goods at the earliest. To comply with the permitted period for revocation, it is sufficient to send off the revocation or the goods in due time. Consequences of revocation In the case of an effective revocation, the mutually received performances and where applicable any benefits derived (e.g. benefits of use) must be returned. If you are unable to restore to COSLINE the performance received in full or in part or if you can restore it only in an impaired condition, you may have to compensate COSLINE for the respective value thereof. This does not apply if the impairment of the goods is exclusively attributable to an inspection thereof – such as you might have been able to do in a shop. For the rest, you may avoid the obligation of value compensation by not using the goods as if they were your own nor doing anything which might affect their value. Goods which can be sent back by parcel post are to be returned. You have to pay the costs of return if the goods delivered are the same as those ordered and if the price of the item to be returned does not exceed an amount of CHF 65,00 or if, in the case of a higher price of the item, you have not yet paid the consideration or a contractually agreed instalment at the time of revocation. Otherwise the return is free of charge. Goods which cannot be sent back by parcel post will be collected from you. You have to meet any payment obligations within 30 days of posting your declaration of revocation. Special instructions: Your right of revocation shall lapse prematurely if COSLINE has begun to perform the service with your express consent before the end of the revocation period or you yourself have prompted this. V. Reservation of ownership The delivered goods shall remain the property of COSLINE until the purchasing price is paid in full. VI. Delivery time The delivery time is one week from receipt of payment and applies subject to unforeseeable obstacles. VII. Items that are not available If a certain item is not available, COSLINE undertakes to inform you of this unavailability prior to accepting the order. In such cases COSLINE reserves the right to send you a substitute item which is equivalent in price and quality. If you do not wish to accept or keep this, you may return it to COSLINE free of charge within the statutory warranty period. VIII. The statutory claims shall apply at the buyer’s choice within the statutory warranty period for defective products or delivered products that are not in compliance with the contract. COSLINE reserves the right to assert claims for compensation against the buyer for damage that arose from the following causes: - inappropriate or improper use - natural wear and tear - incorrect or negligent treatment. 3. COSLINE is not under any obligation to remove any defects as long as the buyer is in default of his or her payment obligations. 4. The warranty period is governed by the statutory provisions. X. Data protection COSLINE warrants that it will collect, process, store and use customer data accruing on the occasion of orders only in connection with processing the order. Insofar as the customer does not wish any data to be used for internal marketing purposes of COSLINE, the customer has the right to object to this use at any time by sending an e-mail to coselle (at) cosline.ch * (please take note of the notice below). XI. Other agreements If individual provisions of these General Terms and Conditions are legally ineffective, this shall not affect the validity of the remaining provisions. The legally ineffective provision shall be replaced by such a provision that comes as closest as possible to its commercial meaning. XII.
